The Spanish Civil Aviation Accidents and Incidents Investigation Commission (CIAIAC) has issued an interim report as result of the Investigation of the accident occurred on August 20th 2008 in Madrid-Barajas airport to aircraft McDonnell Douglas DC-9-82 (MD-82), registered EC-HFP, operated by Spanair.

The accident took place at 14.24 local time during the take-off by runway 36L, at the beginning of the flight JKK5022 departing from Madrid-Barajas and destination to Gran Canaria airport.

This interim report is the one mentioned in paragraph 6.6 of Annex 13 to the Convention on International Civil Aviation. The report is issued as a continuation of the preliminary report published on 8 October 2008. The report includes details on the progress of the investigation and the most salient operational safety issues that have emerged to date.

Data from the Investigation as described in the report indicate that the take-off maneuver was performed with the flaps and slats retracted, which constituted an inappropriate configuration for this flight phase, and that most probably the crew did not extend those high-lift devices for the take-off. Data from the investigation indicate also that the system designed for warning the crew of an inappropriate configuration for take-off did not activate. Based on these conclusions the CIAIAC considers that improvements should be taken in the area of design operations so that future accidents as this one can be prevented.

With the interim report 7 safety recommendations are issued. One is addressed to the European Aviation Safety Agency (EASA), another one to the Federal Aviation Authority in the United States (FAA), four are issued both to EASA & FAA and finally there is one recommendation addressed to EASA, FAA & International Civil Aviation Organization (ICAO).

The investigation is ongoing. In the interim report the most relevant aspects still pending to be finished are highlighted. At the conclusion of the investigation a final report will be issued detailing every aspect involving safety as it relates to this accident.
